The Remedial Use Approval authorizes the use of the our System where the local approving authority, generally the board of health, finds the following:

• a) that the System is for upgrade of a failed, failing or nonconforming system, and
  
• b) the design flow for the facility is less than 10,000 gallons per day, and there is no increase in design flow to the failed system.
  

The RSF System, in this Remedial Use Approval, cannot be used for new construction or where there is any increase in design flow.

An owner can be granted the following Title 5 variances for Remedial Use Applications:

• 50% reduction in the size of the soil absorption system;
  
• Reduction of up to two feet in the depth to estimated high ground water;
  
• Reduction in te depth of naturally occurring pervious material.
